1. Objective

The objective of general conditions of sale is, firstly, to inform any potential buyer the terms and conditions under which the seller makes the sale and delivery of ordered goods and, secondly, to define rights and obligations of the parties in the context of sale of goods by the seller to the consumer.
They apply, without restriction or reservation, to all sales of products offered on this website by the company fabrics by yard.
Consequently, for any person who orders a product offered on the website fabrics by yard, takes full acceptance of these terms and conditions of sale which Buyer has acknowledged before his order.
The products are offered for sale on the following geographic territory: Metropolitan France. The Buyer, prior to his order, said:

Buyer is personally responsible for using computer and telecommunications to access the website of fabrics by yard.
The Purchaser shall pay the cost of telecommunications when access to the Internet and use of the website.

4. Information of contract & orders

4.1. Rates

The prices of products online at the website fabrics by yard, are in Euros or Livres, and take effect at the time of registration of order by the Buyer.

4.2. Product features

The characteristics of each product sold on our website are presented on the site. The colors of products that are displayed on our site cannot be guaranteed because of the capabilities of images resolution by computer systems.
However, the buyer has a right of withdrawal under the conditions set out below.
All our products are designed to meet the characteristics that the buyer can expect in terms of their nature and their function.
No particular need can be taken into account, unless it has been expressly agreed.

4.3. Product Availability

Our products can be sold in the limits of available stocks.
If, despite the formation of an order, a product was unavailable, the sale will be resolved and any sum paid by the buyer will be refunded as soon as possible and no later than thirty days.
For products not stocked in its warehouses, the offers proposed by fabrics by yard are valid according to availability of its suppliers.
Based on the constraints of availability of its suppliers, fabrics by yard reserves the right to guarantee the restocking & alter the products.

 
4.4. Unit and minimum quantity purchase

The products sold on the website fabrics by yard are either sold by the meter or by the unit.
In the context of products sold by the meter, the minimum purchase is 1 m. Beyond 1 m, it is possible to order for every of 1m.
In the context of products sold by the unit, the minimum purchase is 1 unit. Beyond a unit, it is possible to order for every 1 unit.

4.5. Order

Any order implies the acceptance of these terms and conditions of sale.
From the moment the buyer has registered his order by clicking on the "Order", it is deemed to have accepted consciously and without reservation, these general terms and conditions of sale, prices, volumes and quantities of ordered products which offered for sale.

5. Payment

  • Cheque.

fabrics by yard reserves the right to suspend any order and / or delivery, no matter the nature or the moment when this decision is made, if a failure of the system of payment appears, and /or the payment cannot be implemented through the system because of the absence of unavailability of the price which should be transmitted.
However, if the sale is made, and for some reason or another, the payment has not been settled, fabrics by yard reserves the right to make the decision.
Furthermore, under this condition, the debt would grow according to delay penalty interests at the legal rate increased by 5% since the beginning of the contract until the payment.

6. Shipping and Receiving

6.1. General Rules

Delivery will be implemented by the post using the system Colissimo.
Shipping charges are paid by the buyer. The calculation of shipping charges according proportionally to the total weight of the ordered goods.
Products will be delivered to the address specified by the Buyer on the purchase order, in metropolis of France, or in the countries of the European Union.
By default, the invoices are sent to the email address which is specified by the Buyer during registration.
In case of non respect of one of the following processes, no complaint of the buyer would be treated.

 

6.2. Features of the system Colissimo of POST

Orders are sent to buyer's home by his carrier in 48-72 hours working day and buyer sign the receipt of acknowledgement.
In case of absence, the Buyer or the consignee of the ordered products receives a notice of his carrier which allows the Buyer or the consignee to withdraw the ordered products from the nearest post office, during a period of fifteen days.
Buyer must verify, in the presence of the post officer or the carrier, the condition of the packaging of the goods and the delivery content.

In the hypothesis that the Buyer would be any doubt on the status or contents of the parcel, the Buyer shall:

  • to apply the procedure Colissimo (including reporting the damage, claims and reserves) and reject the goods by issuing an immediate finding of fault to the Post who delivered the goods;
  • notify the incidents to the TISSUS PRICE by e-mail contact@tissusprice.com

6.3. Shipping information

Delivery periods begins from the date of payment.
The delivery time is seven working days for metropolitan France (10-14 business days in Europe).
If the deadline falls on a Saturday, Sunday, or holiday, it is postponed to next working day.
The delivery deadline is fifteen working days to metropolitan France (10-45 working days for overseas).
The delivery time will be delayed in case of strike, whether general or special, whether it involves the seller and / or its suppliers.
It will also be delayed in case of failure to deliver, especially by the weather or in case of force majeure.
If the delivery is not made within seven days after the deadline that is fixed above the buyer may cancel the sale by sending a letter with acknowledgment receipt to the seller, except when delivery occurs before the letter is received by seller.

7. Right of withdrawal

fabrics by yard does not accept the delivered parcels with postage due.
The products must be returned to fabrics by yard in perfect condition for resale in their original state (packaging, accessories, notice ...).

8. Reserve Property

fabrics by yard retains full proprietary of the sold goods until it received the total payment, in principal, fee and taxes included

9. Guaranties
